NOTICE OF APPLICATION 

NOTICE IS HEREBY GIVEN that there has been proposed to the Benton County Planning Department, an application (File No. EA 2018-021) dated November 9, 2018 for Site grading and parking lot preparation by: Dianna Kham.  The date of the written determination of completeness on this action is November 16, 2018. The site is located at 4950 Arena Rd West Richland, WA 99353 and is legally described as Lot One of Short Plat 1240 in Section 17, Township 9 North, Range 28 East, W.M.

NOTICE IS FURTHER GIVEN that the Benton County Planning Department will review said application and a public hearing may be scheduled at a later date.  If a public hearing is scheduled, property owners within 300 feet of the boundaries of the project site will receive a public hearing notice. 

NOTICE IS GIVEN that said proposal will be reviewed under the requirements of the State Environmental Policy Act.  The Benton County Planning Department expects to issue a Determination of Non-Significance (DNS) utilizing the optional DNS process set forth in WAC 197-11-355. A copy of the subsequent threshold determination for this proposal may be obtained from the Benton County Planning Department.

NOTICE IS GIVEN that all concerned persons will have fourteen (14) days from the date of publication of this notice to comment in writing on this action.  This comment period may be the only opportunity to comment on the environmental impacts of this proposal. Comments should be submitted to the Benton County Planning Department, P.O. Box 910, Prosser, WA 99350.  Any information submitted to Benton County is subject to the public records disclosure law for the State of Washington (RCW Chapter 42.17) and all other applicable law that may require the release of the documents to the public.

2019 Annual Comprehensive Plan Amendments
LEGAL NOTICE

Complete applications for proposed amendments to the Benton County Comprehensive Plan for 2019 will be accepted by the Benton County Planning Department until 5:00 p.m. on December 3, 2018.  Individuals may propose changes to land use designations, policies, or any other components of the Plan, except for Urban Growth Area (UGA) boundaries.  Applications for comprehensive plan amendments must include all information requested on the application form provided by the Benton County Planning Department.

In the 2019 amendment process, Benton County will be accepting proposals from cities for possible amendments to their Urban Growth Area boundaries. All proposed amendments regarding UGA’s must be made by the cities, the County will not accept proposals from private individuals.  Complete application proposals for the 2019 UGA amendment process will be accepted by the Benton County Planning Department until 5:00 p.m. on December 3, 2018.  Complete  applications for UGA amendments must include all information requested on the application form and spreadsheet provided by the Benton County Planning Department.

NOTICE IS HEREBY GIVEN that there has been proposed to the Board of County Commissioners the following applications.  Public comment will be taken at the public hearings on Tuesday, December 18, 2018, at 9:00 a.m., in the Commissioners Hearing Room, Third Floor, Courthouse, Prosser.  The Board will conduct these hearings to consider all testimony and act upon the Planning Commission’s recommendations.

OA 2018-008 is a proposed amendment to correct an error in Section 10 of Ordinance 611-MAPS relating to a note that is placed on the Official Zoning Map; to add language amending Sections 19, 37, 46,  and 55 of Ordinance 611-PROPERTY DEVELOPMENT STANDARDS-GENERAL STANDARDS regarding minimum Vegetative Lot Coverage OF 40% in the following Zoning Districts: Community Center Residential District, Rural Lands One Acre, Rural Lands Five Acre and Rural Lands 20 Acre and to add language to Section 211 requiring that findings in Ord. 611, §212(d)(1)(i-viii) must be met in order to approve a minor variation.Ordinance Amendment

OA 2018-007 - The adoption of the Draft Official Zoning Map A-4 pursuant to the Washington State Growth Management Act (GMA) RCW 36.70A.130(4) and Benton County’s 2017 Periodic Update, amending the Official Zoning Map A-3 and Ordinance 601 of Benton County to reflect changes within the 2017 Update to Benton County’s Comprehensive Plan and zoning text which includes adding a new zoning district known as the Red Mountain Agricultural District.
